NOTICE OF CONFIRMING OF A PUBLIC PATH ORDER
HIGHWAYS ACT 1980 NORTH YORK MOORS NATIONAL PARK AUTHORITY FOOTPATH 202 COLD KIRBY (SUTTON BANK) DIvERSION ORDER 2012
On 2 May 2013, the North York Moors National Park Authority confirmed the above Order under Section 119 of the Highways Act 1980. The effect of the Order as confirmed is to move the northern end of the footpath 44 metres east of the tight A170 corner at the crest of Sutton Bank as shown on the Order map.
A copy of the Order as confirmed and the Order map have been placed and may be seen free of charge during normal office hours at the Sutton Bank National Park Visitor Centre, Sutton Bank, Thirsk, YO7 2EH until 5 July 2013. Copies of the Order and map may be purchased at a reasonable cost by contacting the Director of Democratic & Legal Services, Legal Services, Scarborough Borough Council, Town Hall, St Nicholas Street, Scarborough, North Yorkshire, YO11 2HG. The Order came into force on 2 May 2013 but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date on which this notice is published, make an application to the High Court.
