NOTICE OF PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER
TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257 WILDLIFE AND COUNTRYSIDE | ACT 1981, SECTION 53A(2)
THE COUNTY COUNCIL OF DURHAM (PUBLIC FOOTPATHS NO. 13 BISHOP MIDDLEHAM PARISH & No. 23 CORNFORTH PARISH)
PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2012
On 24 October 2013 the County Council of Durham confirmed the above order. The effect of the Order as confirmed is to divert Public Footpath No. 13 Bishop Middleham ("FP13") from a point to the west of Highland House, proceeding north westerly to the parish boundary and Public Footpath No. 23 Cornforth ("FP23"), onto a line running from the same point west of Highland House west south westerly, before turning north and running alongside the A1(M) to the parish boundary, and divert FP23 from a point on the parish boundary and FP13, proceeding generally north westerly to Stobb Cross Lane onto a line running from the parish boundary alongside the A1(M) northerly to Stobb Cross Lane, as shown on the order plan. The above order will also modify the Definitive Map and Statement of the Public Rights of Way for County Durham by deleting and adding the footpath described.
A copy of the Order and the Order map may be viewed free of charge at the Council's offices at County Hall, Durham Monday to Friday between 9am to 4pm; online at http://www.durham.gov.uk/Pages/ Statutorynotices. aspx and at Ferryhill Library during normal opening hours. Copies of the Order and map may be bought there at the price of £1.15.
The order came into force on 17 October 2013 but if any person aggrieved by the order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and County Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to the Act.
