NOTICE OF PUBLIC PATH DIVERSION & DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER HIGHWAYS ACT 1980, SECTION 119 WILDLIFE AND COUNTRYSIDE ACT 1981, SECTION 53A(2) THE COUNTY COUNCIL OF DURHAM (PUBLIC FOOTPATH NO. 3 EDMUNDBYERS PARISH)
PUBLIC FOOTPATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2013
On 5th December 2013 The County Council of Durham confirmed the above order made under section 119 of the Highways Act 1980 and section 53A of the Wildlife and Countryside Act 1981. The effect of the order as confirmed is to divert Public Footpath No. 3 Edmundbyers Parish from a point on the B6306 in Edmundbyers Village, proceeding in a northerly direction for some 82m to a point at the entrance of Struthers Farm, then in a westerly direction for some 22m then in a generally northerly direction passing to the west of the farm for some 79m to a point on the access track to the caravan park to the north of the farm onto a line running from a more westerly point on the B6306 in Edmundbyers Village, proceeding along the access track in a generally north westerly direction for some 64m, then generally north easterly for 108m to the same point on the access track to the caravan park north of the farm, as shown on the order map. The above order will also modify the Definitive Map and Statement of the Public Rights of Way for County Durham by deleting and adding the footpath described.
A copy of the order and the order map may be seen free of charge at the Council's offices at County Hall, Durham 9am-4pm Mon-Fri; on the Council's website and also at Consett Library during normal opening hours. Copies of the order/map may be bought there at the price of £1.15.
The order comes into force on 12 December 2013, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 19 December 2013, make an application to the High Court.
