Notice Of Confirmation of a Public Path Diversion
Notice Of Confirmation of a Public Path Diversion and Definitive Map and Statement Modification Order Highways Act 1980 Wildlife and Countryside Act 1981 North Yorkshire County Council
On 31 March 2015, North Yorkshire County Council confirmed the following Orders made under Section 119 of the Highways Act 1980 and Section 53A(2) of the Wildlife and Countryside Act 1981.
The effect of the Orders as confirmed is to divert the public footpath described below and modify the District of Hambleton (outside the North York Moors National Park) definitive map and statement accordingly.
Footpath No. 10.66/1 Hornby Green Farm, Hornby Diversion Order 2015
The section of footpath which commences at Grid Reference NZ 3706 0482 and runs south-east then east-north-east to Grid Reference NZ 3748 0464 onto a new route commencing at the same start point and running east along a stone track then south-east along the field edge to Grid Reference NZ 3744 0476, then south-south-east to the same end point, and
the section of footpath which commences at Grid Reference NZ3750 0459 and runs south-south-east then east to Grid Reference NZ 3752 0456 onto a new route commencing at the same start point and running east to Grid Reference NZ 3751 0459, then south-south-east the same end point.
Footpath No. 10.66/1 Grange Farm, Hornby Diversion Order 2015
The section of footpath which commences at Grid Reference NZ 3632 0469 and runs easterly past Grange Farm to Grid Reference NZ 3670 0466, onto a more southerly route between the same end points via Grid Reference NZ 3663 0458. A copy of the Orders as confirmed and the Order Maps have been placed and may be seen free of charge during normal office hours at Northallerton Library, North Yorkshire until 29 May 2015. Copies of the Orders and Maps may be purchased there at a cost of £2.00 each, or can be downloaded free from our website www.northyorks.gov.uk/ pathnotices.
The Orders come into force on the date on which the Authority certifies, in accordance with Section 119(3)(b) of the 1980 Act, that work to the new section of path, described in part 2 of the Schedule, has been completed, but if a person aggrieved by the Order(s) wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order(s), he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from 17 April 2015, make an application to the High Court.
