NOTICE OF CONFIRMATION OF A PUBLIC PATH
ORDER HIGHWAYS ACT 1980, YORKSHIRE DALES NATIONAL PARK AUTHORITY
FOOTPATH NO.34, BURTON-CUM-WALDEN AND
FOOTPATH NOS. 1 & 9, NEWBIGGIN DIVERSION ORDER 2015
On 24 June, 2015 the Yorkshire Dales National Park Authority confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order as confirmed is to divert the public Footpath No. 34 in the Parish of Burton-cum-Walden from a point in a field approx. 240 metres north east of Forelands House at Grid Reference SE 0102 8581 and running south westerly to a pedestrian gate before continuing south, south westerly to join the access track and turning west, south westerly to a field gate, passing in front of Forelands House to a field gate and continuing south, south west to another field gate at the Parish Boundary and its junction with Footpath No. 1 in the Parish of Newbiggin at Grid Reference SE 0085 8560 onto a line starting at the same point at GR SE 0102 8581 south, south westerly to a fence-line and then south west to a pedestrian gate, continuing south westerly crossing the access track and uphill along a track to a field gate, following the track south westerly to the Parish Boundary and junction of the newly diverted Footpath No. 9, Newbiggin at Grid Reference SE 0084 8553, as shown on the Order map. The above Order will also divert the public Footpath No. 1 in the Parish of Newbiggin from a point on the south western side of a field gate at the Parish Boundary and junction with Footpath No. 34, Burton-cum-Walden at Grid Reference SE 0085 8560 and running in a southerly direction for approx. 20 metres to its junction with Footpath No. 9, Newbiggin at SE 0085 8559 before bearing west downhill to a fence-line and to a point east of a stile at GR SE 0077 8559, onto a line running from this point at GR SE 0077 8559, uphill in a south easterly direction for approx. 90 metres to the junction of Footpath No. 9, Newbiggin at Grid Reference SE 0083 8553, as shown on the Order map. The above Order will also divert the public Footpath No. 9 in the Parish of Newbiggin from its junction with Footpath No. 1, Newbiggin at SE 0085 8559 and running in a south, south westerly direction for approx. 58 metres to its junction with the newly diverted Footpath No. 1, Newbiggin, onto a line running from this point at Grid Reference SE 0083 8553, east, north east to the Parish Boundary and junction with the newly diverted Footpath No. 34, Burton-cum-Walden at Grid Reference SE 0084 8553, as shown on the Order map. A copy of the Order as confirmed and the Order map have been placed and may be seen free of charge during normal office hours at the Yorkshire Dales National Park Authority Office at Yoredale, Bainbridge, Leyburn, North Yorkshire DL8 3EL until 21 August, 2015. Copies of the Order and map may be obtained there and at the Yorkshire Dales National Park Authority Office at ‘Colvend’, Hebden Road, Grassington, Skipton BD23 5LB, free of charge. The Order comes into force at the end of 42 days from the date of confirmation of this Order, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 10 July, 2015, make an application to the High Court.
