NOTICE OF CONFIRMATION OF A PUBLIC PATH ORDER HIGHWAYS ACT 1980

FOOTPATH NO. 10.136/5, ELMTREE HOUSE TO STATION FARM, SOUTH OTTERINGTON DIVERSION ORDER 2008
On 17 June 2015, North Yorkshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980.
The effect of the Order as confirmed is to divert the following sections of public footpath. First Section: Commences at its junction with a bridleway at the Parish boundary approximately 224 metres north of Elmtree House and runs generally south for approximately 306 metres, then generally south-east for approximately 233 metres, then generally south-south-east along a field edge for approximately 252 metres, then east-north-east along a field edge for approximately 157 metres onto a new route commencing at its junction with a bridleway at the Parish boundary approximately 409 metres north-east of Elmtree House and running south along a track for approximately 329 metres, continuing south along a field edge for approximately 344 metres, then west-south-west for approximately 56 metres to the continuation of the footpath at a gap in the hedge approximately 580 metres south-east of Elmtree House. Second Section: Commences at a point approximately 43 metres north-north-west of Otterington Hall Farm and runs east-north-east for approximately 21 metres, then south-south-east for approximately 163 metres to a stile, onto a newroute, commencing at the same start point and runs south-south-east for approximately 28 metres, then follows a track generally south-east in an easterly arc for approximately 90 metres, then south-south-east for approximately 74 metres to the continuation of the route at the same stile.
Third Section: Commences at a point approximately 268 metres south-east of Otterington Hall and runs generally south-east for approximately 463 metres, running through Station Farm caravan site, then south-south-east along a track for approximately 171 metres to its junction with Station Road onto a new alignment commencing at the same start point and following a field edge generally south for approximately 47 metres to a stile, continuing south for approximately 27 metres, then generally east for approximately 57 metres to a footbridge, then generally south-east for approximately 208 metres to a gap, continuing generally south-east along a track for approximately 284 metres to its junction with Station Road.
A copy of the order as confirmed and the Order Map have been placed and may be seen free of charge during normal office hours at Northallerton Library, North Yorkshire until 21 August 2015. Copies of the Order and Map may be purchased there at a reasonable cost. The Order comes into force on the date on which the Authority certifies, in accordance with Section 119(3)(b) of the 1980 Act, that work to the new section of path, described in part 2 of the Schedule, has been completed, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from 10 July 2015, make an application to the High Court.
