THE parents of murdered shopworker Jenny Nicholl - who would have been 23 today - are still waiting to hear if her killer will be allowed to appeal.
Unemployed gardener David Hodgson, of Olav Road, Richmond, was found guilty of murdering Miss Nicholl in February.
He was sentenced to life in prison and told he must serve a minimum of 18 years.
However, within weeks his defence team had asked for permission to appeal against the conviction.
The hearing was expected to take place this summer, but delays at the Court of Appeal have repeatedly pushed back the start.
Poignant birthday messages where left yesterday on a website set up by Jenny's family after her disappearance.
One message reads: "Jenny we can't send you a card or present any more for your birthday, but someone as special as you will be loved and remembered always."
A spokeswoman for the Court of Appeal said: "The appeal process is still in its early days.
"It hasn't been decided if it will go to a single judge yet."
Jenny's body has never been found.
It is understood police are waiting for the outcome of the appeal before restarting searches for Jenny's body.
Sources said the searches could include cliffs and rocky outcrops between Richmond and Downholme.
It is believed the area has been searched before, but experts believe a more detailed inspection is required.
Detectives could also speak to Hodgson in prison to see if he will reveal the location of her body.
